Foodeena provides an online platform for selling FMCG goods such as food, beverages and other food products. By using the Services, you automatically agree to the Terms of Service.
The range and prices of products may differ depending on the delivery location. User might be contacted by Foodeena to confirm the order. The User may not be able to alter or add items to the order once it has been confirmed. A confirmed order is eligible for cancellation for a limited time period until the status turns to en-route.
The primary objective of Foodeena is to deliver all the products ordered in the right quantity and to a high-quality standard. User acknowledges that the products are subject to stock availability. Foodeena reserves the right to amend your order in whole or in part, at any time and without liability or compensation remove any item that is out of stock, damaged, spoiled, or unavailable, to successfully complete your order. It’s in our best intention to maintain the replaced item’s price the same as per the brand you ordered but in case of a higher valued replacement, the price may increase. If, however any product you order is out of stock or unavailable we may send you a push notification enabling you to select a substitute. If an item is not delivered, despite being billed, the amount in question will be credited to the User at a reasonable time after Foodeena becomes aware of this. No subsequent delivery is obligatory to be made, and the customer is not entitled to claim any further compensation.
This web site is operated by Foodeena, Subsidiary of Lootah Group (“we”, “us” or “our”). By using the Foodeena .com website you are bound by these terms and conditions. Accordingly, you should check prior to each use or order to ensure that you understand the precise Terms and Conditions applicable to your site visit or purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date and time when these Terms and Conditions were most recently updated.
We will confirm acceptance of your order. We will notify you through SMS or e-mail. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
Price and Delivery Charges
The price of the goods will be as quoted on the website at the time you confirm your order subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged will be those applicable to the new item(s) at the time that the amended order is confirmed. The promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.
Where applicable, prices include Value Added Tax.
Each order you make may include a charge for delivery. If your delivery is subject to a delivery charge, it will be shown to you as a separate charge on the delivery confirmation page before you confirm your order. Any delivery charge added to your order will be dependent upon, amongst other things, the value of your order, the date and time of your delivery and your delivery address. Charges may vary from week to week.
Methods of Payment
By placing an order, you authorize us or our third-party payment processer to process your credit/debit card details for the amount of your order. We accept payment by,
- credit/debit card (Option – Contactless Delivery)
- cash on delivery
In order to authorize credit/debit card payments, we may required to create an account for you with our third-party payment processors, including accepting their standard terms and conditions and submitting your details to them on your behalf. You hereby authorize us to do so and we shall not be liable to you for any damage or loss you may incur as a result.
We may remove or add cards or other payment method that we accept at any time without prior notice to you.
For delivered products, we will refund to you the product amount (excluding the amount paid for the original shipping fees and bank charges if payment done through debit/credit cards as per bank policy)
For products not delivered, you will receive a full refund if you cancel the order excluding the bank charges if payment done through debit/credit card.
Delivery will be made to the address specified by you during the order process on the website.
Delivery will be free with a minimum purchase of AED 149 in Dubai / Sharjah & Ajman. If the order value doesn’t reach the minimum order value the delivery charges may apply which would be AED 15 in Dubai / Sharjah & Ajman.
Delivery charges in other Emirates may be or may not apply based on the minimum
order value purchased, which will be notified to the customer.

Limitation Of Liability
Nothing in these Terms of Sale shall limit or exclude a party’s liability:
- for fraud, including fraudulent misrepresentation, perpetrated by that party;
- for death or personal injury caused by the negligence of that party; or
- for any other liability that cannot be limited or excluded under applicable law
- in no event will we, our parent company, subsidiaries and affiliates, and our and their directors, officers, agents, employees, suppliers, subcontractors or licensors be liable, whether based on an action or claim in contract, tort, negligence, breach of statutory duty or otherwise arising out of or in relation to these Terms of Sale for loss of profits, loss of data or information, business interruption or other pecuniary loss or for any special, indirect, incidental or consequential damages, even if we, our affiliates, directors, officers, agents, employees, licensors, subcontractors or suppliers have been advised of the possibility of such damages.
- supplying the products late or not supplying any part of them if this is caused by you not giving us the information, we need within a reasonable time of us asking for it or making payment as required;
- delays or disruptions to our application or our services
You agree to indemnify and hold us, our parent company, subsidiaries and affiliates and our and their directors, officers, agents, employee, suppliers, subcontractors or licensors harmless from and against any losses, damages and expenses (including legal fees and attorney’s fees) arising out of or relating to:
any claims or demands made by any third party due to or arising out of your use of the Application and our services; your violation of any of provisions of these Terms of Sale, including, without limitation, any of the warranties, representations and undertakings; or your violation of any applicable laws.
